On June 3, 1996, the Military Highway Water Supply Company ("Military Highway"), a non-profit utility, dug a hole to install a water meter at the site.2  The hole is approximately 3 feet in diameter and is located more than 20 feet from the edge of FM 732. The Military Highway administrator testified that because the Texas Department of Transportation also has relaxation powers over the area, Military Highway must comply with the Department regulations.

Those regulations and corresponding Military Highway policies require Military Highway to backfill the excavation pit after installation is complete. However, the Military Highway did not fill the hole. In July 1996, a neighboring landowner informed Military Highway that the excavation had not yet been filled in, but no further action was taken by public authorities.

Road Test Results

Several relatives and properties of Morin and Bautista sued Military Highway for negligence. After a fair trial, the jury found Military Highway and Morin liable for 52% and 48%, respectively, and awarded damages to plaintiffs Morin and Bautista.

The trial panel entered the sentencing section. Military Highway appealed, asserting that Morin and Bautista had no obligation under the law and that there was insufficient legal evidence that the accident was a predictable result of Military Highway's failure to fill the bench.

114 S.W.3d at 732.   The Court of Appeals held that Military Highway was obligated to Morin and Bautista based on the facts of this case and that there was sufficient legal evidence to support the foreseeable conclusion.

In 2012, the Wingecarribee Shire Council was notified of the possibility of asbestos being present on the unsurfaced road surface of some roads in the Robertson area. The Board takes any such notice seriously and immediately conducts an inspection and reports to the property owner.

The board is also responsible for ensuring that people without access to automobiles have access to facilities necessary for their daily activities and, to the extent possible, people with physical disabilities do not have limited access due to that disability.

This is an act of unjustifiable death and survival resulting from an automobile accident that occurred on and adjacent to Farm-to-Market Highway 732 ("FM 732") in Cameron County. FM 732 is a two lane highway with a speed limit of fifty-five miles per hour.
